Bolton dad attacked man leaving ex-partner’s home

A DAD who assaulted a man who was leaving his ex-partner’s home has been ordered to 100 hours of unpaid work.

Bolton magistrates heard a non-molestation order banned 45-year-old Zana Hamasalih from going to Walmley Grove, Bolton.

But on March 20 he received a phone call from his children to say Gary Thorpe, who was not supposed to be at their home, was there.

Ignoring the court order, Hamasalih and another man went to the street where he saw Mr Thorpe leaving the property.

Shannon Stewart, prosecuting, told how Hamasalih ran towards him, kicked his motorbike and started punching him to the head and face.

“This has forced Mr Thorpe to have to use self-defence and to place the defendant in a headlock,” she said.

A second man ran to help Hamasalih fight Mr Thorpe.

In a victim statement read out in court Mr Thorpe said: “This incident had left me feeling scared.”

Hamasalih, of Nixon Road, Little Lever, pleaded guilty to assault and breaching a non-molestation order.

Peter Broderick, defending, said Hamasalih, who works as a barber, had gone to the street after a receiving a phone call from his children to say Mr Thorpe was at their home.

“He wasn’t supposed to be at the address when the children were there,” said Mr Broderick.

Mr Broderick stressed that Mr Thorpe did not sustain any injury in the incident.

Magistrates sentenced Hamasalih to a community order for 12 months, which includes 100 hours of unpaid work and 15 days of rehabilitation activities. He must also pay a total of £330 in costs and charges.

“We understand fully that you must have been concerned as Mr Thorpe should not have been at the address,” magistrate Gillian Knowles told Hamasalih.

“It is imperative that you understand that the law cannot be taken into your own hands. There are channels available which you must go through.”
