Instagram has announced today that they are allowing the option for users to prevent the embedding of images on third party articles and blog posts. The ASMP (American Society of Media Photographers) spearheaded the 9-month long campaign who tout it as a win for photographers and visual creators on Instagram.
The ASMP sent Instagram CEO Adam Mosseri and Meta CEO Mark Zuckerberg a letter backed by 6 other organisations asking for the right to embed to be revoked. The ASMP recalled a raft of copyright infringement problems due to embedding, especially calling to mind two lawsuits between photographers and media outlets.
The court cases, Sinclair v. Ziff-Davis and McGucken v. Newsweek, both involved photographers images being embedded from their Instagram feed by media, and confusingly despite both cases being nearly identical, they had opposing outcomes with one judged to be fair use under the Instagram terms and conditions, the other as a copyright infringement due to no sub-license existing.
Instagram has finally been forced to respond saying that it was never their intention to grant a sublicense via the embedding feature, which was claimed by multiple third parties.
Now users are able to decide for themselves whether they wish to allow embedding from Instagram, just as YouTube users have been able to do for some time. The ASMP call it an important step in the right direction for advocacy for photographers, saying that they “commend Instagram on their inclusion of this feature, and are proud of ASMP’s advocacy work for more than nine months on achieving this result from one of the largest social media platforms in the world.”

- Tap your profile picture (or the person silhouette) in the bottom right to go to your profile.
- Tap the three lines in the top right, then click “Settings”
- Top “Account” then tap “Embeds”
- Toggle the button next to “Allow people to embed your posts or profile on other websites”
- On Instagram.com on your computer:
On desktop:
- Click your profile picture in the top right corner, then click “Settings”
- Click “Privacy and Security”
- Below “Embeds” click to check the box next to “Allow people to embed your posts or profile on other websites”
